No Valid Driver’s License (NVDL) is often confused with Driving While License Suspended (DWLS) because usually police officers do not know how to read a person’s driving record or traffic print out (TPO). This charge is usually issued to people who have actually never had a valid driver’s license and therefore does not affect a person’s Habitual Traffic Offender (HTO) status.

DWLS is broken down into two different charges. DWLS with knowledge of the suspension is a second degree misdemeanor, and prosecutors will try to pin this on you if they think they can prove it. This presents an opportunity for your DWLS attorney to get the charge changed to DWLS without knowledge, which is a non-criminal infraction.

Although an NVDL charge is preferable, it is still a second degree misdemeanor. Penalties can run as high as a $500 fine and 60 days in jail. And although jail time can often be avoided, a conviction will result in a permanent criminal record, which may be the worst part.
