Miami Dog Bite Lawyer
Animal attacks such as dog bites can happen in an instant, and can be difficult or impossible to predict. While domesticated animals are usually docile and friendly, we cannot completely eradicate their wild instincts. Few dogs are truly vicious, but any dog can bite or attack when startled or scared – which can happen for many reasons.
Unfortunately, many victims of dog bites and other animal attacks are small children. They do not have the experience necessary to exercise caution around unfamiliar animals. When they approach a dog in the wrong way, the results can be tragic.
Florida Statutes §767.04 establishes that dog owners are liable if their dog attacks someone, even if the dog never before displayed any viciousness and the owner had no reason to believe the dog would attack. This is in contrast to most personal injury liability, which depends on the injury having been foreseeable.
It’s important to note you don’t have to suffer an actual bite in order to seek compensation. You may have been knocked down, chased, or had a dog injure your pet or damage your property. The dog owner may be liable in each of these cass.
Landlords may also be responsible for a tenant’s dog attacking someone. This, however, does require the plaintiff to show that the attack was foreseeable.
Compensation available to dog bite victims includes medical expenses, lost income due to time away from work, pain and suffering, and damage to property.
I am a big believer in responsible pet ownership. Dog owners must know their duty to others’ safety, and if they neglect that duty, they must be held accountable. As your personal injury attorney, I will work as hard as I can to get you the compensation you deserve. And, as with any other case I work, if a fair and just settlement cannot be obtained, I stand ready to take your case all the way to a jury verdict.
Remember, dog owners have a responsibility to prevent their dogs from being able to attack you, regardless of whether they could have predicted the attack. If you or a loved one are attacked by an animal, first seek medical attention immediately. Then call me, Jordan Redavid, for a free initial consultation.
